After consideration of the policy letter entitled ‘Education Governance’ dated 25th November 2024, they are of the opinion:-
- To agree to establish a new Education Governance system in respect of each fully States-funded education setting in Guernsey and Alderney and The Guernsey Institute, to facilitate devolved and delegated governance as described in sections 4 and 5.
- To amend the Education (Guernsey) Law, 1970 and any relevant associated legislation to give effect to the new Education Governance system from the commencement of the 2025/2026 academic year, or as soon as practicable thereafter.
- To agree that the Committee for Education, Sport & Culture should consult with the States of Alderney in relation to the new Education Governance system as it shall have effect in respect of the fully States-funded education setting (St Anne’s School) in Alderney.
- To agree to establish, by no later than December 2025, and in accordance with Rule 53 of the Rules of Procedure of the States of Deliberation and their Committees, a States' Investigation & Advisory Committee to be known as the Education Devolution & Delegation Investigation & Advisory Committee, whose membership shall be as described in paragraph 4.4.3 and whose mandate shall be as described in paragraph 4.4.5 subject to inclusion of the following in the mandate: exploring and, where necessary recommending, the extent to which the proposed governance boards should be responsible and accountable for the selection of the Headteacher or Principal of the relevant educational setting, and their deputies.
- To instruct the Policy & Resources Committee and the Committee for Education, Sport & Culture to each make available the resources necessary for the Education Devolution & Delegation Investigation & Advisory Committee to fulfil its mandate; and, in the event that additional resources are required, to instruct the Policy & Resources Committee to release fund up to £100,000 from the budget reserve.
- To direct the Education Devolution & Delegation Investigation & Advisory Committee to report back to the States of Deliberation with its findings and recommendations as soon as possible but no later than September 2026.
- To direct the preparation of such legislation as may be necessary to give effect to their above decisions.
